  2.                 for Antiviral Toolkit Virus Encyclopedia ("AVPVE")

  7. AntiViral Toolkit Pro Virus Encyclopedia ("AVPVE"), and accompanying
  8. documentation are to be considered FREEWARE. You are hereby granted a
  9. license by KAMI Ltd. to distribute the freeware copy of AVPVE and its
  10. documentation, subject to the following terms and conditions:

  12. The FREEWARE package of AVPVE must be distributed freely without any
  13. charge.
  14.  
  15. AVPVE may not be bundled or included with any hardware or software
  16. without the expressed written consent of KAMI Ltd. or any authorized
  17. distributor.
  18.  
  19. The distribution archive must be distributed in complete form. The
  20. individual files must also be complete and unmodified. The distribution
  21. archive must be without any additional files. ONLY AUTHORIZED DISTRIBUTORS
  22. are granted authority to modify or add files to the distribution archive.
  23. The documentation and files must be distributed together. Any modifications
  24. to the package, including the addition of BBS advertisements is strictly
  25. forbidden.

  27. AVPVE may not be sold or licensed. No fee may be charged for its use.
  28. If a fee is charged in connection with AVPVE at all, it should only cover the
  29. cost of copying or distribution. UNDER NO CIRCUMSTANCES should payment of
  30. such fees be understood to constitute legal ownership.

  32. By granting you the right to distribute the freeware copy of the AVPVE,
  33. you do not become the owner of these utilities or documentation in any
  34. form.

  36. KAMI Ltd. hereby disclaims all warranties relating to Antiviral Toolkit Pro
  37. Virus Encyclopedia by Eugene V. Kaspersky (c) KAMI Ltd. whether express or
  38. implied, including without limitation any implied warranties of
  39. merchantability or fitness for a particular purpose. The person, company,
  40. institution, or government agency using AVPVE bears all risk as to the
  41. quality and performance of AVPVE. In no event shall KAMI Ltd., any
  42. distributor of AVPVE or anyone else involved in the creation, production,
  43. distribution or delivery, of AVPVE, be liable for any damages of any
  44. kind, including without limitation direct, indirect, consequential,
  45. incidental, special, or exemplary damages arising out of the use,
  46. performance, or delivery of AVPVE even if KAMI Ltd. any distributor, or
  47. anyone else involved in the creation, production, distribution or delivery,
  48. of AVPVE has been advised of the existence or possibility of such
  49. damages.  In no event shall KAMI Ltd., any distributor of AVPVE, or
  50. anyone else involved in the creation, production, distribution or delivery
  51. of AVPVE be liable for any claim, whether in contract, tort, or any other
  52. theory of liability.

  54. Using AVPVE, it's utilities or documentaion means that you agree to these
  55. terms and conditions.

  57. Any other use, distribution or representation of the AVPVE is expressly
  58. forbidden without the written permission of KAMI Ltd. or an authorized
  59. distributor.

  61. Mass distribution of AVPVE in magazines or books requires approval from
  62. KAMI Ltd. or a authorized distributor of AVPVE.

  64. AVPVE may be made available on FTP and BBS sites, as well as, included on
  65. CD-ROMs containing other shareware or freeware programs, such as the SIMTEL
  66. and GARBO collection CD-ROMs, provided the conditions below are not
  67. violated.

  69. Any distribution of AVPVE is subject to the following restrictions:

  72. We do not want to have AVPVE distributed together with viruses, virus
  73. source code, virus construction programs or virus creation material such as
  74. 40Hex, Crypt or the Nuke newsletters.  Therefore,

  76.   1) AVPVE may not under any circumstances be made available on a site
  77.      which makes viruses, virus source code, virus construction programs or
  78.      virus creation material available.
  79.  
  80.   2) AVPVE may not be included on a CD-ROM (or any media) containing
  81.      viruses, virus source code, virus construction programs or virus
  82.      creation material.

  84.   3) AVPVE may not be distributed as a part of a package containing
  85.      viruses, virus source code, virus construction programs or virus
  86.      creation material.

  88. We will consider legal action in the case of any violation of these three
  89. conditions.

  92. KAMI Ltd. and authorized distributors reserve the right to revise the
  93. AVPVE software, utilities and written materials, and to make changes from
  94. time to time in the contents without obligation to notify any person.

  99. All AVPVE programs, utilities and documentation are copyright 1992-1996
  100. KAMI Ltd. All rights reserved. If any diskettes are provided with AVPVE
  101. they are not copy protected.

  103. The AVPVE programs, utilities and documentation are protected by
  104. copyright law, which applies to the computer software as well, except for
  105. that you may make copies of the software solely for backup or archive
  106. purposes and transfer the software to hard disk provided that the software
  107. is used as specified herein.
